Have your say on proposed changes to the charities sector

Creative New Zealand is advocating for robust policy that will promote a vibrant and more transparent charities sector. We’re encouraging others to join us in supporting our draft submission, or to make a submission of their own.

Modernising the Charities Act 2005 is looking at ensuring the Act is fit for purpose and can deliver to the needs of a wide range of charities. Many arts organisations are structured as charities, making a modernised, functioning Charities Act important for a dynamic and resilient arts sector.

“We feel it’s important to advocate for the needs of our sector given the number of arts organisations affected by the Act,” says David Pannett, Creative New Zealand’s senior manager for advocacy. “But we’re also encouraging artists and arts organisations to make submissions on their own experiences– it’s this first-hand knowledge that will be of real value during the consultation process.”

Arts, culture and heritage charities form the third largest group of charities. Creative New Zealand’s submission advocates ‘to support and sustain a robust, vibrant, independent, and innovative charities sector.’

More than three in four (78%) of Creative New Zealand’s investment clients are charities. They are major arts organisations that play a significant role in New Zealand’s arts infrastructure, and the policies put in place have the potential to influence New Zealanders’ confidence in them and their capacity to deliver value as charities.

Creative New Zealand’s submission has focused on the parts of the consultation document relevant to the arts sector, including:

  • vision and policy principles of flexibility and cost-effectiveness
  • additional purposes of the Act: a robust and independent sector and greater transparency
  • obligations of charities: accumulation of funds and governance standards
  • greater clarity surrounding the capacity of a charity to advocate.

Consultation on Modernising the Charities Act 2005 closes at 5pm, Friday, 31 May 2019. Creative New Zealand will continue to work on its draft submission and encourages others to make submissions of their own.
