Draft bill updating century old Incorporated Societies Act welcomed

The Ministry of Business, Innovation and Employment’s (MBIE) work to update the Incorporated Societies Act, which has been in place since 1908, has been welcomed by Creative New Zealand.

Submissions on MBIE’s Exposure Draft: Incorporated Societies Bill close on 30 June 2016.

The 1908 Act sets out how incorporated societies should be set-up and administered, including a prohibition against operating for the financial gain of its members, and how they should be governed and monitored.

MBIE’s exposure draft clarifies the roles and responsibilities of officers and gives guidance for the resolution of disputes, conflicts of interest, complaints and grievances.

Creative New Zealand’s submission supports the proposed changes because they will help “ensure officers are able to spend their time advancing their society’s purposes instead of being constrained by time consuming legal ambiguity”.

“Societies should be guided by strong legislation while remaining free from inappropriate government interference.  We believe this exposure draft strikes a reasonable balance.”
